Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the EkTrek mobile application, the EkTrek website (ektrek.ekrasunya.com), and related services (together, the "Services"), provided by Ek Ra Sunya Inc ("EkTrek", "we", "us", or "our").

Please read these Terms carefully, and pay particular attention to Section 5 (Safety and Assumption of Risk) and Section 6 (Disclaimers), which are important for a trekking application. By downloading, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

EkTrek provides trekking information for the Himalayas, including trek discovery, day-by-day itinerary planning, offline-capable topographic maps with GPS position, tea-house and waypoint information, and altitude and safety guidance. The Services are offered on an "as available" basis and may change, expand, or be discontinued over time.

The Services are intended for users aged 18 and over. By using the Services you confirm that you are at least 18 years old.

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

- use the Services in any way that violates applicable laws or regulations; - attempt to gain unauthorised access to our systems, servers, or data; - interfere with, disrupt, or overload the Services or our infrastructure; - reverse engineer, decompile, or attempt to extract source code except as permitted by law; - scrape, copy, or redistribute our content in bulk without permission.

Trek routes, descriptions, safety guidance, imagery, the EkTrek name and logo, and the software are owned by or licensed to Ek Ra Sunya Inc and are protected by intellectual-property laws. Map data is provided by OpenStreetMap / OpenTopoMap and is subject to their respective licences. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for your personal, non-commercial trekking use.

Trekking and mountaineering in the Himalayas are inherently dangerous activities. They involve serious risks including but not limited to altitude sickness (AMS, HACE, HAPE), extreme weather, avalanche, rockfall, falls, hypothermia, getting lost, remote locations with limited or no communication, and limited access to medical care or rescue.

- EkTrek is a planning and navigation aid, not a substitute for proper preparation, training, fitness, a qualified guide, appropriate equipment, travel insurance, or your own judgement. - Information in the App (including trails, altitudes, tea-house details, weather, and safety guidance) may be incomplete, out of date, or inaccurate. Trail conditions change; map and GPS data can be imprecise, especially in mountainous terrain and offline. - Do not rely solely on EkTrek for navigation or safety-critical decisions. Carry backup navigation, share your itinerary with others, obtain the required permits, secure insurance that covers high-altitude evacuation, and heed local authorities and guides. - The altitude and safety content in EkTrek is general information, not medical advice. Consult a qualified medical professional regarding altitude illness and your fitness to trek.

You use the Services and undertake any trek entirely at your own risk, and you assume all risks associated with your activities.

To the maximum extent permitted by law, the Services and all content are provided "as is" and "as available", without warranties of any kind, express or implied, including any warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, accurate, or available in any particular location.

To the maximum extent permitted by applicable law, Ek Ra Sunya Inc and its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, or for any personal injury, illness, or death, arising out of or relating to your use of (or inability to use) the Services or reliance on their content, even if advised of the possibility of such damages. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

The Services rely on third-party providers (for example OpenStreetMap/OpenTopoMap for map tiles). We are not responsible for the content, accuracy, availability, or practices of third-party services, which are governed by their own terms.

We may modify or discontinue the Services, in whole or in part, at any time. We may also update these Terms; when we do, we will revise the "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

We may suspend or terminate your access to the Services at any time if you breach these Terms or use the Services in a harmful or unlawful manner.

These Terms are governed by the laws of Nepal, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Services shall be subject to the jurisdiction of the competent courts of Nepal, to the extent permitted by applicable law.
